General Terms and Conditions for Acquiring the Jawwal Pay Electronic Wallet Services

A Guide to the General Terms and Conditions for Subscribing to “Jawwal Pay” Services

First: The guide to the general terms and conditions for subscribing to “Jawwal Pay” services

This agreement includes the terms and conditions governing the user's utilization of Jawwal Pay services, and is considered a binding contract between the user and the National Electronic Payment Company as the company providing electronic payment services. Signing it is an acknowledgment by the user of his acceptance of these terms and conditions, which can also be viewed through the National Electronic Payment Company’s website (www.JawwalPay.ps) or on Jawwal Pay application, or that are available at dealers and service delivery points.

  1. Services offered by Jawwal Pay e-wallet

The user of the Jawwal Pay e-wallet can benefit from the following payment services through the application:

    • Feeding the account/making deposits into the account: through purchasing electronic money from any agent or point of sale that works for or with Jawwal Pay.
    • Cash withdrawal: the possibility of exchanging electronic money for cash -shekel currency exclusively- and within the limit of the balance that can be withdrawn at any time through dealers and service points for Jawwal Pay.
    • Transferring electronic money locally from one user of the service to another.
    • Pay bills electronically.
    • Buying electronic cards such as Apple and Google cards
    • Cash withdrawal: the possibility of exchanging electronic money for cash -shekel currency exclusively- and within the limit of the balance that can be withdrawn at any time through dealers and service points of Jawwal Pay.
    • Recharge mobile phone balances and internet bundles.
    • Purchase service from websites or local electronic applications.
    • Issuing the virtual global payment card from the wallet.
    • Any other services that are introduced/launched subsequently after obtaining the Palestinian Monetary Authority's prior approval.

 

  1. Service subscription requirements
    • The user may open only (one) electronic money account with Jawwal Pay for each ID number as the main identifier.
    • It is permissible to subscribe to Jawwal Pay services  through self-registration for the service 
    • The user shall abide by the instructions related to the classification of categories and ceilings, which are determined by the Palestinian Monetary Authority and published by the National Company for Electronic Payment on its website. The ceilings for financial orders related to the user's account in all currencies are as follows:
  • The maximum user account ceiling at any given time is 4,000 US dollars or equivalent in other currencies.
  • The total limit for all payments and transfers per month using the user account is 4,000 US dollars or its equivalent in other currencies.
  • Feeding and transferring to the user's account is 4,000 US dollars per month or equivalent in other currencies.
  • Maximum limit for cash withdrawal from the user's account is 1,000 US dollars per month or equivalent in other currencies.
  • The services provided to the user on the temporary wallet account are limited to feeding the electronic wallet with a ceiling of 300 US dollars or its equivalent in other currencies to be used in purchases only.

The maximum limit for the affiliate wallet account is $500 per month, or its equivalent in other currencies, and it is considered part of its e-wallet’s ceiling. The maximum limit for cash withdrawals and all payment and transfer operations is $500 per month, or its equivalent in other currencies.

 

  • The user declares that he is the original owner and the real (sole) beneficiary from opening the account.
  • Jawwal Pay applicant acknowledges that all information provided is true, complete and accurate.
  • Jawwal Pay shall have the right to halt any application for subscription to the service in the event of any shortage of documents or a defect in the user's documents, and Jawwal Pay will take the necessary measures to inform the user of correcting or submitting the documents required to complete the registration process for the service.
  • Jawwal Pay shall have the right to decline to open any account if it is not convinced with the personal identification documents provided or in compliance with other instructions issued by the Palestinian Monetary Authority.
  • When subscribing to Jawwal Pay, the user will receive a secret code through a text message for the purpose of activating the account, after which the user will be able to use Jawwal Pay services to make transactions on the e-wallet; Taking into consideration that the user can change the secret code at any time.

 

  1. Jawwal Pay Services Terms
  • In the event that the SIM card on which the user's number is designated is damaged, lost or stolen, the user must immediately inform his mobile phone company of such damage, loss or theft, by contacting the company's user service center to stop the damaged, lost or stolen SIM card from working. This is to prevent further use of Jawwal Pay services until the card is replaced or repaired.
  • The user must disclose to the National Electronic Payment Company transferring his account from one SIM card to another or changing his mobile phone number.
  • The National Electronic Payment Company is not entitled to disclose any personal information or documents related to the user, as well as to disclose details of any activity on the user's account, except for the reasons authorized by the instructions of the Palestinian Monetary Authority related to the subject matter.
  • Jawwal Pay obtains the user's consent to access their contacts and location for the purpose of transferring funds using the mobile device and/or identifying the nearest agent/merchant to the user. Jawwal Pay does not store any personal information related to contacts or locations obtained after the wallet's usage is completed. Additionally, it does not collect, use, or disclose contacts or locations for any other purpose.

 

  1.  Suspension & Termination of the Service
  • The National Electronic Payment Company has the right to partially or entirely suspend Jawwal Pay services, block, restrict or terminate them, and/or close the electronic account and/or suspend the use of the secret code or disconnect them without any responsibility on the National Electronic Payment Company whatsoever, and without notice in the following cases:
  • In the event that the National Company for Electronic Payment has a reason that the user's mobile devices, user line, or secret code used to obtain Jawwal Pay services are used in an unauthorized, illegal, inappropriate, fraudulent manner, or in criminal activities (or has been used in this way previously).
  • In the event that the user does not take into account any of the conditions, regulations or instructions related to the use of Jawwal Pay services, including these terms of use.
  • In the event that the user notifies the National Electronic Payment Company that any of the mobile devices has been lost or stolen, or that the secret code has been stolen or disclosed to any other person.
  • Upon receiving a duly request from the user to close the account.
  • If the company knows or has been officially notified that the user's mobile phone number is not active.
  • The National Company for Electronic Payment shall not bear any responsibility towards the user in any way for any loss, malfunction or damage, whether direct, indirect, consequential or special arising from any act or omission on the part of the user in the event that the account is closed or suspended according to this paragraph.
  • The National Electronic Payment Company freezes the electronic wallet account according to the instructions issued by the Palestinian Monetary Authority in this regard, as follows:
  • The e-wallet account on which no transactions are made shall be frozen after one year has passed from the date of using the account, provided that the user is notified thirty (30) days prior to the effective date of the freeze.
  • Excluded from the freezing mentioned in the previous paragraph are account movements related to commissions and fees charged by the company.
  • The dormant account is activated after the user submits a re-activation request and acknowledges the validity of the account balances at the moment of activation.
  • The company is committed to closing the user's account at his request without delay or affecting his obligations.
  • The company complies with all instructions of the Palestinian Monetary Authority related to freezing, reactivating, and closing the account.

 

  1. Fees
  • The National Electronic Payment Company is committed to revealing the prices for using the service available now and later in several ways, such as publishing them on the website, the application, newspapers, sending text messages to users, or through leaflets that are found in its showrooms, if any, and at the showrooms of authorized dealers and merchants.
  • After the successful completion of each payment service through Jawwal Pay e-wallet, both the recipient and the sender will receive a confirmation notice that includes a transaction reference number, payment order type, value and currency type, fees and commissions deducted, exchange rate if any, date and time of executing the payment order, besides notifying them with the latest balance in their respective accounts. All Jawwal Pay system records are correct unless proven otherwise.
  • Through Jawwal Pay electronic application, the user can obtain a statement of the financial transactions that were carried out according to the period specified.

 

  1.  Security Aspect and Unauthorized Use

Each account has one secret code through which the user can access the account, and the user only has the right to use the mobile device and the secret code related to his account in Jawwal Pay services

  • The user is responsible for protecting his mobile device and using it correctly, and he is also responsible for maintaining the confidentiality of his secret code and preserving it from loss, besides the fact that he is responsible for all Jawwal Pay transactions that take place through his account using his secret code; also, the user has the right to change the secret code of his electronic wallet directly.
  • Although the user must identify himself when conducting any Jawwal Pay transaction using the mobile phone and the special secret code, he is prohibited from disclosing his secret code to any person, including the user service center employee and / or the employee of the authorized agent centers.

 

  1. User Responsibilities
  • The user acknowledges that all the information and documents provided for the purposes of opening an electronic money account with Jawwal Pay and for the purposes of Know Your Customer (KYC) procedures are correct and pertaining to him/her. The user is obligated to provide Jawwal Pay with any changes/amendments that may occur to any of the information he provided, as the user bears full responsibility for his breach of his obligations under this clause.
  • The user is responsible for all charges imposed on any Jawwal Pay transaction that is made using his/her secret code, whether those other transactions were made by the user or by another person with or without the user's authorization or knowledge, and the user is also responsible for all fees related to any process of feeding or withdrawing from the account.
  • The user shall be personally responsible for feeding the electronic money/e-wallet account or whomever he authorizes based on the relevant instructions of the Palestinian Monetary Authority.
  • The user is obligated to use the service in compliance with the relevant laws in force, including the relevant instructions of the Palestinian Monetary Authority, where the user is prohibited from using the service for illegal purposes or that violate public order and morals, and the user is also prohibited from carrying out any operations that are related to illegal activities or violation of laws and regulations, including those related to money laundering or terrorist financing, where the user bears full responsibility for his breach of his obligations under this clause, and is also obligated to compensate the First Party for any damages incurred as a result.
  • Inform Jawwal Pay immediately from the moment the User becomes aware of any possible error in their accounts and/or any unauthorized order that has been executed or when payment devices are stolen or lost.
  • Informing Jawwal Pay of the loss, theft, or unauthorized use of the prepaid card or the card linked to the electronic wallet or encryption codes and security information by contacting the User Service Center and reporting it officially according to the procedures followed by Jawwal Pay which are published on the company's website.
  • Submitting the objection by the user within a maximum period of (45) forty-five days on any payment order from the date of debiting the account.
  • The User Service Center is available for Jawwal Pay users 24 hours a day, 7 days a week, to receive all inquiries and complaints and to provide services related to the electronic wallet or its operations at 1700 555 555, or by sending an email to (info@JawwalPay.ps ), and for more information about the e-wallet account, please visit the company's website www.jawwalpay.ps
  • Jawwal Pay provides users with multiple means to communicate with the company, and the handling of complaints is as follows:
  • Complaints are documented through a complaints system that contains the complainant's information (name and means of contacting him/her), details of the subject of the complaint, and the addition of any supporting documents to the complaint.
  • It may be processed during the call through the information officer and thus have it closed.
  • The user receives a notification of receipt of the complaint by the company.
  • The user will be notified of any deficiencies within a maximum of (4) four working days from the date of submitting the complaint, and the user will be given a period of (5) five working days to complete it.
  • The user will be answered within a maximum period of (10) ten working days from the date of submitting the completed complaint, and he will be notified of the final decision regarding the complaint with the reasons.

 

  1. Liability and Exclusions
  • The company has the right to disclose any of the user's information to the regulatory authorities or by virtue of a court decision, in compliance with the instructions of the Palestinian Monetary Authority.
  • The company has the right to verify all the data submitted to it by the user from any party the company deems appropriate and to exchange personal and financial information with the Palestinian Monetary Authority from its date until the end of the contractual relationship with the company.

 

  1. Changes
  • The National Electronic Payment Company reserves the right to make the necessary changes to these terms of use and/or fees at any time and to notify the user of that 30 days prior to making the changes.
  • Changes are announced by SMS to users and on the website and the application of the National Electronic Payment Company and through leaflets that are found in its showrooms, if any, and at the showrooms of authorized dealers and merchants, or through any other appropriate means, as this advertising medium will be considered sufficient for the user to be considered officially notified.
  • The user's constant use of Jawwal Pay service will be considered a tacit acceptance of the changes made above.

 

Second: Terms and conditions for prepaid e-shopping cards

These terms and conditions (“Terms and Conditions”), represent the agreement concluded between the National Company for Electronic Payment, operating under the trademark (Jawwal Pay) (“the company”, “we”), which is located in (Palestine, Ramallah, Al-Masyoun, PRICO Building, and licensed by the Palestinian Monetary Authority,) and You as the Cardholder (“You”, “Cardholder”, “User”), where You acknowledge that the MasterCard e-shopping card is a prepaid card owned by the Company (“Electronic Shopping Card”) and you must protect it from loss, theft and illegal use because it represents an electronic personal money wallet and that you are the cardholder and the owner of the cardholder and the person whose name is associated with it, and you agree to these terms and conditions when you purchase it and / or start using it.

  1. Information related to the electronic shopping card
  • You acknowledge and know that your use of your electronic shopping card must be in accordance with the legislation in force in Palestine and that the operations authorized to be carried out comply with any regulations or instructions issued by the Palestinian Monetary Authority and MasterCard International, and that you are aware of them and that you cannot use your e-shopping card for any fraudulent or suspected fraudulent operations, or in violation of the legislation in force, including those related to money laundering and terrorist financing, or suspicious operations, or that harm the trademark of the National Electronic Payment Company (Jawwal Pay) or the private trademark by MasterCard, including those related to money laundering and terrorist financing, or suspicious operations or that harm the trademark of the National Electronic Payment Company (Jawwal Pay) or the trademark of MasterCard, where the company has the right to take the measures it deems appropriate and according to its absolute and exclusive discretion, in compliance with the applicable law and/or instructions of the Palestinian Monetary Authority and/or MasterCard International, and you will be held responsible for the financial and legal consequences of any of these operations.
  • The currency used to conduct transactions through the electronic shopping card is US dollars.
  • The electronic shopping card does not provide cash withdrawal services, including withdrawals through ATMs, purchases at points of sale, transfer to and from the electronic shopping card, or recharge.

 

  1. Responsibility and Error Correction Procedures
  • We will not be liable for any loss or damage (whether direct or consequential) to the extent permitted by law, nor will we be limited by these Terms and Conditions, for failure to observe or perform any of our obligations for any reason or cause which cannot; with reasonable care, be controlled or prevented by us. Such causes include, but are not limited to: Fate, acts of nature, cases of negligence by governments or their affiliated bodies, other industrial strikes, fire, floods, storms, riots, electrical shortage or failure, or sudden disruption of the system caused by war or Vandalism, acts or negligence of third parties.
  • In the event that your electronic shopping card is lost, whether it is stolen, damaged or misused, you should immediately contact the company's user service center.

 

  1. Confidentiality of Cardholder Information
  • The company is committed to maintaining the confidentiality of the cardholder's information and the operations that take place on it, provided that the company has the right to disclose any of the user's information to the supervisory authorities or by virtue of a court decision, in compliance with the instructions of the Palestinian Monetary Authority, or the international MasterCard company in cases that require reporting or others.

 

  1.  Responsibility for Dispute Resolution
  • When you object to any of the transactions that took place on the electronic shopping card, please contact the User Service Center directly or review any of the company's dealers, within the time period specified by the laws or regulations in force from the date of the transaction.
  • The company is responsible for processing objected transactions in compliance with the laws and instructions of the Palestinian Monetary Authority and MasterCard International in this regard.

Third: The Applicable Law

  • This contract shall be governed and interpreted in accordance with the applicable and enforceable laws of the State of Palestine, and disputes arising from or related to it shall be referred to the competent Palestinian courts.
  • These terms and conditions are valid and approved by the National Electronic Payment Company and are effective as of 01/01/2020.
